GENERAL TERMS AND CONDITIONS
General terms and conditions define the conditions of purchase through the website Chivava Style, available at the link chivavastyle.eu and is intended for presentation and sale of products to the user. It is operated by company CHIVAVA., Rudl Boštjan s.p.,Spodnja Polskava 123, 2331 Pragersko SI-2331 , Slovenia. General terms and conditions also apply for orders, placed through e-mail, phone or official website’s Facebook page.
General terms and conditions term working of the online store, user rights and business relationship between the provider and the customer. If you do not wish to accept these terms and conditions, please do not use the website.
AVAILABILITY OF INFORMATION
Provider is committed to always provide to the customer the following information:
- the identity of the company (name and place of business, registration number),
- contact information, allowing the user quick and effective communication,
- the essential characteristics of the goods or services,
- availability of products,
- validity of the offer,
- the period within which it is possible to withdraw from the contract and the conditions for withdrawal,
- an explanation of the appeal process, including the details of the contact person or department for customer contact.
All prices are clearly and unambiguously defined. The colour of the product in the picture may differ from the actual colour of the product.
All prices are in euros (€) and they are the final price . Prices are valid at the time of order and do not have a predetermined force. For product descriptions and prices, errors may occur. We reserve the right to change the prices without prior notice. All prices and special offers are valid until the deadline referred to the promotion offers. The prices listed on the website do not include the cost of postage.
REGISTRATION AND PURCHASE OF PRODUCTS
Upon registration, the visitor obtains the user name, identical to its e-mail and password. Username and password unambiguously define and connect the data input. As a visitor confirms his registration, he becomes a user and obtains the right to purchase.
The provider has made every effort to display as accurately as possible the colours of his products that appear on the website. However, as the actual colours you see will depend on your monitor, we cannot guarantee that your monitor's display of any colour will accurately reflect the colour of the product on delivery.
All sizes and measurements are approximate; however the provider makes every effort to ensure they are as accurate as possible.
On the website user selects a product, marks the colour and size of the product and clicks on the "add to cart" button. Clicking on the basket icon allows the user to see added products, which can optionally be removed from the basket. If the user wishes to complete the purchase, he clicks on the icon "checkout". User must first log in to register and enter necessary personal information. If he is already registered, he must register with his username and password. The user selects the payment method. After placing the order, he receives an automatic e-mail message that his order has been accepted with the details of the contract. The user will be by e-mail also informed when the order is sent.
If the user wants to change the contract or to cancel entirely, he can do so via e-mail email@example.com at any time before the order is shipped. If the order was already shipped, the buyer refuses the shipment by delivery service.
Provider reserves the right to refuse an order. Non-acceptance of an order may, for example, result from one of the following:
• the product ordered being unavailable from stock
• our inability to obtain authorization of payment
Credit card/Debit card/Paypal
You can pay safely with Paypal, by credit card or debit card (we use Paymill). In case you decide to pay by credit card please indicate your credit card number as well as the date of expiry of your credit card on the order form. Apart from shipping and handling no further costs will arise.
Payment in advance by bank transfer
With the order confirmation you will get all the information details to execute the payment. Payment is due in 5 working days.
Your order will be proceed as soon as we received the payment on our account.
Usually we send out your order within 1 - 3 days after receipt of your payment. The final delivery date depends on your destination country, for EU countries is usually 3 working days from sending the order, but should not take longer than 18 days within Europe. Exception is for products that have under their description warning: DELIVERY FROM 7 – 14 WORKING DAYS. Goods are subject to availability. As there is a delay between the time when the order is placed and the time when the order is accepted, the stock position relating to particular items may change. If the goods are not in stock, the supplier will notify you via e-mail, set a reasonable deadline for delivery of goods or cancel the order.
Delivery time is expressed in number of working days. If the delivery takes longer, provider will send you an e-mail notification of the expected delay of delivery. Provider reserves the right to temporary or permanent limit or discontinues the sale of certain products, or even all. Provider deserves the right to, for a definite or indefinite period of time, restrict access to the online shop or completely stop access to the online store or otherwise restrict or suspend the operation of the online store.
Please make sure that you receive an undamaged package (if necessary open the package in the presence of the postman). Do not, in any case accept a damaged delivery (e.g. an opened box or similar) since by doing this you implicitly confirm the reception of undamaged items.
RETURNS AND REFUND POLICY
Buyer has the right to return ordered goods without stating any reasons. Provider is obligated to offer an exchange of goods or refund.
The buyer can exchange the goods only for exactly the same item, in which he can choose a different size and/or color. If the provider is not in a state to deliver replacement goods within thirty (30) days of receipt of the returned goods, he is committed to refund.
Returned merchandise has to be unused and undamaged, therefore exactly as new - with original packaging. Copy of the receipt has to be added to the package, which has to be sent within fifteen (15) days from receipt, in that the buyer himself covers the direct shipping costs of the returned goods. After this period the return is not possible.

The refund will be made the same way the buyer chose to purchase the goods, either it will be credited back to the credit card that was used to purchase the goods or it will be wired to the buyer’s bank account. The refund will be made as soon as possible, but no longer than thirty (30) days after receipt of returned goods.
When the buyer returns an entire order he will be refunded the price of the item paid at the time of purchase, and the delivery charge. When he returns less than the entire order he will be refunded just the price of the items returned.
Provider uses the appropriate technological and organizational means to protect the transmission and storage of personal data, orders and payments. Provider takes no responsibility and shall not be liable for any damage to computer and/or mechanical equipment or other property and any virus entries, which may affect the user's equipment to visit the website, downloads texts, images, data, and video and audio recordings. User is also solely responsible for the security of their user data and passwords. The user is responsible for the accuracy and truthfulness of all transmitted data and is liable to the provider for any damage due to incorrect or false information.
THE RIGHT TO PRIVACY
Provider is committed to sustainable protection of personal data in accordance with the. All information, obtained from the website, will be used solely for the fulfillment of the contract/refund/exchange, the sending of information material, offers, invoices and other necessary communications. Promotional e-mails must be clearly labeled as advertising messages, the sender clearly evident. The provider shall use their best efforts to ensure currency and accuracy of the information, published on its website. However, the characteristics of products, delivery or price change so rapidly that the provider fails to correct the information on the website. In this case, the buyer will be informed about the changes and allow the assignment of the contract or ordered a replacement item. All photos are illustrative only and do not guarantee product features. Shades and appearance of products may differ from the actual product.
